big brother is watching, and you can't ask how or why

This is wrong on so many levels, I don't know where to start. Yes, the authorities should and need to be on the look out for terrorists and terrorist activity. Yes, they need to keep track of what they've found out. But no, they should not have unrestricted rights to act on it or to not be accountable for what they are tracking and how they are accumulating the information.
