court case update
Mar. 7th, 2007 09:13 pmPre-trial hearing was today. He showed, with attorney and an obviously hastily written reply to my complaint. So the insanity continues. The Judge will issue a written order to commence discovery Tuesday. We have 90 days to swap lists of evidence, anticipated witnesses, do depositions and all that happy stuff.
The trial will be scheduled for sometime in late August or early September. If discovery goes well for me (and I can't see how it can't, but anything is possible), they may be willing to settle. I can't imagine that his attorney doesn't think I don't have the documents to back-up my complaints, but she's certainly acting that way. What's interesting is the number of facts he agreed to in the complaint that he'd previously denied in the written examination.
Oh, they are counter-suing as well. But the counter-claim was fairly boilerplate stuff, no new evidence, no new allegations, no new facts introduced, and no statute, rule, or precident case cited. I have to find out what the order of events are, and then I can file a motion for summary judgement and ask the Judge to dismiss the counter-claim.
So lots more reading for me, but I do get the rest of the week off from this and that is nice.
