Nov. 5th, 2007 08:58 pmThe trial in my court case is this Thursday and Friday. My opposition has, today, filed a motion to withdraw as counsel for the Defendant. The hearing on the motion is set for Thursday, so she'll have to show anyway. I am constantly amazed at her need to blame:
"Mr. McKerley has not cooperated with undersigned counsel’s preparation for trial and has broken the terms of his fee agreement with the firm. These issues have been brought to Debtor’s attention and he has not rectified them.
Preparations for trial are extremely, if not impossible, for undersigned counsel given the Debtor’s lack of cooperation."
And yes, that's an exact quote from the motion.
I'm still working on questions for the trial and still have to put together my evidence notebooks. I don't know if the Judge has a choice about letting her withdraw, or if he will offer a continuance, and in which case I will object. For whatever that will be worth.
