Jan. 17th, 2005 11:07 pmI've a big day on tap for tomorrow. Busy day for work planned, and then meeting with my attorney at 3 to discuss my house situation. I've not gotten a reply to my letter from the contractor. Doing nothing isn't an option as there's too many significant safety-related things about the house that need finished (or started or fixed). I'm hoping he's going to go to his business insurance company and ask them to settle. That's his best option to get out of this as soon as possible--and mine as well. On the other hand, I've no idea what to expect as realistic as far as a settlement. Half? A third? A quarter of what I'd sue for? I'll find out tomorrow, I suppose.
The attorney I have seems to be a straight shooter, so I'm counting on him to be honest about my chances in Superior court vs. just going to Small Claims court. The former will take 4-6 months to resolve but offers me a chance not only to recover the costs for the final work but also the loss of value where he cut corners as well as my legal fees.
Either way I'll get some closure, the house will get *really* finished, and I can get on with my life. Such as it is.
