
I've finally finished my reply to the Objections on the Summary Judgment Motion on the Counterclaim. My brain is mush. I have to do the same tomorrow for the Objections on the Summary Judgment Motion on my Claims. That part will actually be easier, as the Statement of Facts I filed were the same for each, and conveniently the Objections on the Facts were the same as well.
I'm actually faced with the possibility that I may prevail on any one of my 7 claims but not on my Motion to make the Counterclaim go away. I don't know if that would mean that the trial would be on for just the Counterclaim. I'm thinking if I prevail on any of claims 3-7 which would remove his bankruptcy dischange, that this would make the Counterclaim moot. The Counterclaim ultimately asks for the Trustee to recover money from me on behalf of the Defendant's estate; however, if there is no need for a Trustee if his bankruptcy discharge is revoked, then the Counterclaim becomes baseless and goes away too. I think. I hope. It would be nice if it worked like that.
